Thus, workers' compensation laws put in place caps on employer liability and provided injured workers immediate - yet reduced - benefits and eliminated the need to prove negligence or fault.

It does not matter if the employer went out of business after your injury occurred. The insurance carrier who used to insure your old employer will have to pay the claim. Again, if the employer did not have insurance coverage, there are other sources of payment. Also, if the insurance company went out of business, you are still protected.
